Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Strata Reports AI platform and related services (the "Service") provided by Brighter Day Software Pty Ltd trading as Strata Reports AI ("Strata Reports AI", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Definitions

1.1 "Account" means an individual or entity's user account on the Service.

1.2 "User", "you", or "your" refers to any individual or entity accessing or using the Service.

1.3 "Reports" means the strata/condominium reports generated by the Service.

1.4 "Report credit" means a single-use credit that allows you to generate one Report. Credits may be included with a new account or purchased per report.

2. Eligibility

2.1 You must be at least 18 years old and capable of entering into binding contracts under Australian law.

2.2 The Service is available only to users who can form legally binding contracts with Brighter Day Software Pty Ltd trading as Strata Reports AI.

3. Account Registration & Free Reports

3.1 Account creation requires a valid email address and acceptance of these Terms.

3.2 Every new account receives two free report credits once its email address is confirmed.

3.3 After using your free report credits, you may purchase further reports individually. There is no subscription or recurring billing.

4. Per-Report Pricing & Payment

4.1 Each additional report costs A$20 + GST (A$22 including GST). We reserve the right to change pricing, with at least 30 days' notice. The price is shown before payment.

4.2 All fees are in AUD and payment is processed by Stripe. Each successful payment provides one report credit. You authorize the payment you confirm at checkout.

4.3 If a paid report is unusable, contact support. We review the case for a retry, replacement report credit or refund where appropriate. Refunds are not automatic except where required by law.

4.4 A paid report requires an available report credit before processing can proceed.

5. Use of the Service

5.1 You may use the Service to draft Reports for your professional business purposes, including delivery to your clients after you review and confirm the report against its source documents. You remain responsible for the accuracy, suitability and delivery of your work.

5.2 You shall not (a) reverse-engineer, decompile, or otherwise attempt to extract the AI algorithms; (b) resell, sublicense, or distribute access to the Service without prior written consent; or (c) use the Service in violation of any applicable law. This restriction does not prevent professional client delivery of Reports under clause 5.1.

6. Intellectual Property

6.1 Brighter Day Software Pty Ltd trading as Strata Reports AI and its licensors retain all rights, title, and interest in the Service, including all AI models, software, trademarks, and related materials.

6.2 You retain ownership of any input data you upload and any Reports you generate. You grant us a limited license to use your data solely to provide and improve the Service.

7. Warranties & Disclaimers

7.1 The Service is provided "as is" and "as available". Strata Reports AI disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7.2 We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

8.1 To the maximum extent permitted by law, Strata Reports AI's total liability arising out of or related to these Terms shall not exceed the total report fees paid by you in the 12 months preceding the claim.

8.2 In no event shall Strata Reports AI be liable for any indirect, special, incidental, punitive, or consequential damages.

9. Indemnification

9.1 You agree to indemnify, defend, and hold harmless Strata Reports AI and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Termination

10.1 You may stop using the Service at any time and contact support to request account closure. There is no recurring subscription to cancel.

10.2 We may suspend or terminate your Account for breach of these Terms or inactivity, with or without notice.

11. Governing Law & Dispute Resolution

11.1 These Terms are governed by the laws of New South Wales, Australia.

11.2 Any dispute arising shall be resolved by the courts of New South Wales.

12. Privacy

12.1 Our Privacy Policy, explains how we collect, use, and disclose personal information. By using the Service, you consent to our Privacy Policy.

13. Notices

13.1 We may provide notices by email or via the Service. You should send notices to support@strata-reports.ai.

14. Changes to Terms

14.1 We may update these Terms from time to time. We will notify you at least 30 days before material changes take effect. Continued use of the Service constitutes acceptance of the updated Terms.
